Stock Trading in Australia: Who Can Legally Be CGT-Free?
Stock trading taxes in Australia can vary significantly depending on your residency status and investment profile. In certain situations, capital gains from shares may be fully exempt from Capital Gains Tax (CGT) — entirely legally.
Understanding who qualifies for exemptions, and which behaviours trigger risk, is essential to avoiding unnecessary tax and ATO scrutiny.
1. Foreign Investors
If you are classified as a non-resident for Australian tax purposes, capital gains from Australian-listed shares may be exempt from CGT.
- You reside overseas long-term;
- You do not maintain a permanent home in Australia;
- You have no intention to settle permanently;
- You do not maintain a primary residence in Australia.
In most cases, buying and selling Australian-listed shares is CGT-free for non-residents.
Additionally, if you hold less than 10% of a listed company, the shares are treated as non-taxable Australian property (non-TAP assets), qualifying for the Foreign Resident CGT exemption.
2. Temporary Visa Holders
Some temporary visa holders qualify as “temporary residents” for tax purposes and may access special CGT concessions.
- Hold a temporary visa (e.g. 482, 485, WHV);
- Stay in Australia for 183 days or less in the financial year;
- Do not intend to become a permanent resident.
Tax benefits may include CGT exemptions on overseas investments, and partial CGT exemptions on Australian shares acquired before becoming a tax resident.
3. High-Risk Behaviours to Avoid
- Believing that not providing a TFN avoids tax (it does not);
- Trading through a family member’s overseas account;
- Frequent trading that resembles professional trading activity.
In such cases, the ATO may reclassify gains as ordinary income, deny CGT discounts, and impose penalties.
4. Increased ATO Monitoring
The ATO now cross-checks data from Australian brokers, overseas accounts, and bank transactions, significantly increasing audit accuracy.
