1. The Employee Is Covered by an Award
In many industries, including hospitality, retail, cleaning, construction, and childcare, Awards explicitly require employers to pay a 17.5% loading during annual leave.
Where an Award applies, payment of Annual Leave Loading is compulsory.
2. An Enterprise Agreement Applies
If an Enterprise Agreement includes a provision for Annual Leave Loading, employers must comply with its terms.
3. The Employment Contract Specifies Loading
Even if an employee is Award-free, Annual Leave Loading becomes mandatory where it is expressly stated in the employment contract.
When Is Annual Leave Loading Not Mandatory?
Annual Leave Loading is generally not compulsory when:
  • The employee is Award-free;
  • No Enterprise Agreement applies; and
  • The employment contract does not mention loading.
Important Note on Annualised Salaries
Where employees are paid an annualised (packaged) salary, employers must be able to demonstrate that the salary includes the value of Annual Leave Loading.
Without sufficient evidence, Fair Work may require back payment of wages and impose penalties.
